Terms of Service

Introduction

All persons who use Eligible (the “Platform,” which includes all websites, apps, servers, digital communications services, databases, and all other digital features, plus any in-person events and other activities that are organized off-line owned, operated, managed, or released under the Eligible brand) agree to these terms of service (“ToS”) and such terms govern their use of the Platform for the period of time they are using the Platform, during the entire period of any subscription or membership that gives them access to the Platform, and for so long as they are availing themselves of the Platform’s features, storing their content and submissions on the Platform, or otherwise using or exploiting the Platform and its benefits, offerings, and any original content drawn from the Platform. Such persons are referred to as “Users” and as “You” and “Your” throughout the ToS. The terms “We” “Us” and “Our” generally refer to Eligible and, at times, those terms include, where context allows, Our officers, directors, employees and agents, and, at times, Our various commercial partners.

Intellectual Property

We are the owner or the licensee of all intellectual property rights in Our Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You must not use any part of the materials on Our Platform for commercial purposes without obtaining a license to do so from Us or Our licensors.

If You print, copy or download any part of Our Platform in breach of these terms of use, Your right to use Our Platform will cease immediately and You must, at Our option, return or destroy any copies of the materials You have made.

If You believe Your intellectual property rights have been infringed by Our Platform content, please contact Us by email at [email protected].

Viruses, Hacking, and Other Offenses

You must not knowingly introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material. You must not attempt to gain unauthorized access to Our Platform or database connected to Our Platform.

If You breach this provision, You are committing a criminal offense under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will cooperate with those authorities by disclosing Your identity to them.

We will not be liable for any loss or damage caused by viruses or other technologically harmful material that may infect Your computer equipment, computer programs, data, or other proprietary material due to Your use of Our Platform or Your downloading of any material posted on it, or on any website linked to it.

Links from Our Website, App, and Digital Communications

Where Our Platform contains links to other sites and resources provided by third parties, these links are provided for Your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from You using them. When accessing an external site via Our Platform We advise You to check their terms of use and privacy policies to ensure compliance and determine how they may use Your information.

Hold Harmless Agreement

As a condition of using Our Platform and for so long as You are subject to these ToS as set forth above, You agree to fully indemnify Us, defend Us, and hold Us harmless from any and all lawsuits, claims, demands, liability, causes of action, loss, injury, and/or damages of any kind whatsoever, whether brought by an individual or an entity, or imposed by a court of law, or by administrative action of any federal, state, or local government body or agency, or by any arbitral board or tribunal that purports to have its rulings or findings enforced in any court of law, arising out of, in any way whatsoever, any omissions, acts, negligence, or willful misconduct on Our part (including Eligible’s officers, directors, employees, agents, and its commercial partners). This includes legal fees and expenses and related costs entailed in bringing and defending the foregoing scope of indemnified matters. You agree that We are not responsible or liable in any way for the personal encounters you have through Your use of the Platform, as both a matter of law, including the Communications Decency Act, 47 U.S.C. § 230, and by virtue of these ToS.

How to End Your Eligible Membership

We want the connections You make through Our services to last forever, but We keep Your personal data only as long as necessary for legitimate business reasons. If You decide to end Your membership, You can close Your account by emailing [email protected] and Your profile will no longer be visible to other members. Note that We will close Your account automatically if You do not pay Your annual membership fee.

Following account closure, We delete Your data as laid out below:

1. To protect the safety and security of Our members, We implement a safety retention window of three months following account closure or up to two years following an account ban. During this period, We keep Your data to investigate unlawful or harmful conduct. The retention of data during this safety retention window is based on Our legitimate interest as well as that of potential third-party victims.
2. We maintain limited data to comply with legal data retention obligations: in particular, We keep transaction data for 10 years to comply with tax and accounting legal requirements, credit card information for the duration the user may challenge the transaction, and “traffic data” / logs for one year to comply with legal data retention obligations. We also keep records of consents members give Us for five years to comply and evidence Our compliance with applicable law.
3. Finally, We maintain data on the basis of Our legitimate interest where there is an outstanding or potential issue, claim or dispute requiring Us to keep data, in particular if We receive a valid legal subpoena or request asking Us to preserve data (in which case We would need to keep the data to comply with Our legal obligations) or if data would otherwise be necessary as part of legal proceedings.

Note

All of the rights expressly stated herein are in addition to and not exclusive of any and all other rights and remedies available to Us, at law or in equity. We reserve the right to revise or amend these ToS at any time without advance notice and You agree to be bound by the updated language upon your next use of Our Platform.

This Privacy Policy applies to websites, apps, events and other services of Our Platform that We operate under the Eligible brand. Whether you’re searching online, joining Us at one of Our events, or using any of Our other awesome services, this Policy has You covered. For simplicity, We refer to all of these as Our “service” in this Privacy Policy.

If You leave Our Platform via a link or otherwise, You will be subject to the policy of that website provider. We have no control over the policy or terms of other websites. It is Your responsibility to check their policy before continuing to access them.

If for some reason, one of Our services requires its own separate privacy policy, then that policy will be made available to You and that policy — not this Privacy Policy — will apply.

Data We Collect

Eligible is committed to protecting and respecting Your privacy. We keep certain basic information when You visit Our Platform and recognize the importance of keeping that information secure and letting You know what We will do with it.

We may electronically collect, store, and process the following information about you:

• Information that You provide by filling out forms on Our Platform, including Our events. 
• Information provided at the time of joining the Eligible community or requesting further assistance, as it may be updated and enhanced by You over time.
• Information You provide when reporting an issue with Our Platform.
• Surveys that We use for research purposes; although You do not have to respond to them.

Where We Store Your Personal Data

All information You provide to Us is stored on Our cloud-based server. Any payment transactions will be encrypted. Where We have given You (or where You have chosen) a password which enables You to access certain parts of Our Platform, You are responsible for keeping this password confidential. We ask You not to share the password with anyone and to follow best practices for creating and securing Your password, and log-in and verification credentials.

How We Use Your Information

We use information kept about You in the following ways:

• To verify Your identity.
• To create and maintain Your account and profile on Our service.
• To respond to Your requests and questions.
• To carry out Our obligations arising from any contracts between You and Us.
• To notify You about changes to Our service.
• To process payments.
• To analyze how Our service is used.

Children Online Privacy Act Compliance

We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). We do not collect any information from anyone under 18 years of age. Our website, products and all other features and services comprising Our Platform are all directed to people who are at least 18 years old or older.

We want You to be in control of Your data, so We want to remind You of the following rights, and options available to You. 

• Right to be informed of the personal data We process about You and/or ask for a copy of Your data.
• Right to amend or update Your personal data where it’s inaccurate or incomplete.
• Right to delete personal data.
• Right to withdraw a consent you’ve given Us to process Your personal data for a specific purpose.
• Right to withdraw Your membership from the Eligible community and We’ll delete Your data as laid out in this Privacy Policy. 

You have the right to ask Us not to process Your personal data for marketing purposes. We will usually inform You (before collecting Your data) if We intend to use Your data for such purposes or if We intend to disclose Your information to any third party for such purposes. Our Platform may contain links to and from the websites of Our partner networks and affiliates. If You follow a link to any of these websites, please note that these websites have their own privacy policies and that We do not accept any responsibility or liability for these policies. Please check these policies before You submit any personal data to these websites.

Changes to Our Privacy Policy

Any changes We may make to Our privacy policy in the future will be posted on this page and, when appropriate, notified to You by email. However, We advise that You check this page regularly to keep up to date with any changes.
